Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Beijing Lingxi DeepMind Technology Co., Ltd. ("OléGol", "we", "us", "our") regarding your use of the OléGol mobile application, related websites, and services that link to these Terms (collectively, the "Service").

Read these Terms carefully. By installing or using OléGol you confirm that you are old enough to enter into this agreement and that you accept these Terms. If you do not accept them, do not use the Service.

These Terms include important provisions about AI-generated content, intellectual property, paid features, disclaimers of warranty, and limitations of liability.

1. The Service

OléGol lets you create short AI-generated sports-themed videos from templates, prompts, and uploaded photos. Specific features available to you may depend on:

• Your country, language, and the version of the App you have installed
• Whether you are a guest, a registered user, or a paid subscriber
• Available credits in your account
• Server availability and applicable law

We may add, remove, or change features at any time. Some features rely on third-party AI providers; their availability is outside our control.

2. Eligibility and Accounts

2.1 Age

You must be at least 13 years old (or the minimum digital-consent age in your country, whichever is higher — for example 16 in many parts of the European Economic Area) to use OléGol. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian's consent.

2.2 Account types

• Guest — you can browse and try limited features without signing in. Guest data is tied to a device-level identifier and is not portable.
• Registered user — when you sign in with Apple or Google, your guest data may be merged into your registered account.
• Subscriber — additional benefits as described at purchase time.

2.3 Account security

You are responsible for activity under your account and for keeping your device, Apple ID, and Google account secure. Notify us at liuchunxu@miaoboai.com if you suspect unauthorized use.

3. User Content

3.1 Definition

"User Content" means any photo, image, prompt, caption, template setting, or other material you upload, submit, or input to the Service, as well as the AI-generated outputs produced from your inputs.

3.2 Your rights and license to us

You retain ownership of the User Content you originally own. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, display, and adapt your User Content solely to operate, secure, and improve the Service for you and (in anonymized aggregate form) for other users.

This license ends when you delete the User Content or your account, except for backups and records we are required to keep by law or to defend legal claims.

3.3 AI-generated outputs

Outputs generated for you are made available for your personal, non-commercial enjoyment. Because AI models may produce similar outputs for different users in response to similar inputs, we do not guarantee that any output is exclusive to you or that the output is original, accurate, or non-infringing.

3.4 Your representations

By uploading content you represent and warrant that:

• You own the content or have all rights, licenses, and consents necessary to upload it
• The content does not infringe any intellectual property, publicity, privacy, contractual, or other right
• The content complies with these Terms, applicable platform and store rules, and applicable law
• If the content contains a real person's face, likeness, or other facial information, you have that person's consent and understand that OléGol will process the visible face data only as described in the Privacy Policy to provide the requested AI generation.

3.5 Acceptable Use & Content Rules

By uploading media and generating content, you represent and agree that:

• You own or have all rights and permissions needed for any photo, image, or video you upload, including the consent of any identifiable person who appears in it.
• You will not upload images of other people without their permission, and you will not upload images of public figures, athletes, or celebrities to imitate, impersonate, or suggest their endorsement.
• You will not create content that is unlawful, hateful, harassing, sexually explicit, defamatory, or otherwise objectionable.
• All output is AI-generated and is not affiliated with or endorsed by any real person, team, league, or brand.

We have zero tolerance for objectionable content or abusive behavior, and there is no tolerance for objectionable content or abusive users. We may remove content and terminate accounts that violate these rules. You can report concerns in the App from a generated result by tapping Report content, or by emailing liuchunxu@miaoboai.com.

4. Prohibited Conduct and Content

You agree not to use OléGol to upload, create, generate, share, or attempt to generate any content that:

• Depicts a real, identifiable person (including athletes, public figures, celebrities, coaches, journalists, or private individuals) without their explicit consent, especially in a manner that could be mistaken for genuine endorsement, behavior, or statements
• Falsely depicts a real person committing a crime, expressing political views, endorsing a product, or in a sexual or compromising context
• Could reasonably be mistaken for authentic news, real-event footage, or real broadcast media (you must label outputs as AI-generated whenever sharing publicly)
• Infringes copyrights, trademarks, broadcast rights, club / league marks, team kits, or sponsor logos in a way that could mislead viewers about official endorsement or licensing
• Is sexual, sexually suggestive, exploitative, or depicts minors in a sexual or violent way
• Promotes self-harm, suicide, violence, terrorism, hate based on protected characteristics, or illegal activity
• Harasses, threatens, dox-es, or impersonates another person
• Contains malware, exploits, or attempts to interfere with the Service's security
• Violates any export control, sanction, or other applicable law

You also agree not to:

• Reverse engineer, decompile, or attempt to extract source code or model weights
• Scrape, automate, or use bots to interact with the Service
• Bypass safety filters, age gates, content moderation, or paywalls
• Resell, sublicense, or commercially exploit the Service without our written permission
• Abuse promotional credits, welcome credits, referral rewards, or any free benefits (for example by re-installing or spoofing device identifiers)
• Use the Service to compete with us by training models or building a substantially similar product

We may remove content, restrict accounts, suspend, or terminate access without prior notice if you violate these rules. We may report serious or unlawful conduct to authorities, Apple, or Google Play.

5. Intellectual Property

5.1 Ours

The OléGol name, logo, App, templates, model integrations, code, designs, and other materials provided by us are owned by Beijing Lingxi DeepMind Technology Co., Ltd. or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the App on a device you own or control, solely for personal use.

5.2 Third-party marks

Names and logos of athletes, teams, clubs, leagues, broadcasters, brands, or other third parties referenced in the App or in templates are the property of their respective owners. Their appearance does not imply endorsement, sponsorship, or partnership.

5.3 Feedback

If you send us feedback, suggestions, or ideas, you grant us an unrestricted, royalty-free, worldwide license to use them without obligation to you.

6. Paid Features, Credits, and Subscriptions

6.1 Purchases through Apple or Google Play

All paid features in OléGol are sold through the Apple App Store or Google Play and are subject to the applicable store terms. Payment is charged to your Apple ID or Google Play account.

6.2 Credits

"Credits" are an in-app virtual currency that you can use to generate videos. Credits:

• Have no real-world monetary value and cannot be redeemed for cash
• Are non-transferable between accounts
• Are consumed when you start a generation; consumed credits are not refundable except as required by Apple, Google Play, or applicable consumer protection law
• Credits granted from an Apple App Store or Google Play subscription are valid only for the billing period in which they are granted and expire at the end of that period: Credits from a weekly subscription expire 7 days after they are granted, and Credits from a yearly subscription expire 365 days after they are granted. Unused Credits do not roll over to the next period. Promotional or welcome Credits may expire as disclosed when granted
• May be adjusted (clawed back) if Apple or Google Play refunds your purchase, if a chargeback occurs, or if we detect fraud or abuse

6.3 Subscriptions

Specific subscription terms — including price, billing period, renewal, and benefits — are disclosed in-app at the point of purchase and at https://api-mini.clipclap.net.cn/mobile/subscription-terms.

6.4 Restoring purchases

You can restore previously made purchases on a new device by signing in with the same Apple ID or Google Play account and tapping Restore Purchases in the App.

6.5 Refunds

Refund decisions for store purchases are made by Apple or Google Play. For Apple purchases, request refunds through https://reportaproblem.apple.com or contact Apple Support. For Google Play purchases, follow https://support.google.com/googleplay/answer/2479637. We do not directly issue cash refunds for App Store or Google Play purchases, but we will honor refunds the applicable store grants.

7. Privacy

Our Privacy Policy explains how we collect, use, share, and protect your personal information. By using OléGol you confirm that you have read and understood the Privacy Policy.

8. Push Notifications

If you allow notifications, we may send you alerts about your creations, account, subscription status, or important Service updates. You can turn notifications off any time in your device notification settings.

9. Third-Party Services and Links

OléGol may include links or integrations with services operated by third parties (such as Apple, Google, AppsFlyer, Sentry, and Tencent Cloud). We are not responsible for the content, policies, or practices of those services. Your interactions with third-party services are governed by their own terms.

10. Termination

10.1 By you

You can stop using the Service at any time and delete your account through Me → Settings → Delete account. Please cancel any active Apple or Google Play subscription through the applicable store settings before deleting your account.

10.2 By us

We may suspend or terminate your access, with or without notice, if:

• You violate these Terms, our content policies, or applicable law
• We are required to do so by law, regulation, court order, or Apple
• Continued service to you poses risk to other users, our infrastructure, or our business

10.3 Effect of termination

Sections that by their nature should survive termination will survive, including ownership, disclaimers, indemnity, and limitations of liability.

11. Disclaimers

THE SERVICE AND ALL AI-GENERATED OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that AI outputs will:

• Match any specific person, team, club, league, brand, or event
• Be accurate, complete, original, or free of bias or error
• Be safe to use for any specific purpose

You are solely responsible for reviewing outputs before sharing them and for compliance with applicable laws, including those regarding likeness, broadcast, and intellectual property.

Some jurisdictions do not allow the exclusion of certain warranties. The above exclusions apply only to the extent permitted by law.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL OLÉGOL, BEIJING LINGXI DEEPMIND TECHNOLOGY CO., LTD., OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS.

OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE APP STORE OR GOOGLE PLAY IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD 100.

Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless OléGol, Beijing Lingxi DeepMind Technology Co., Ltd., and our officers, directors, employees, and agents from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right.

14. Apple-Specific Terms (Required by Apple)

The following provisions apply specifically because OléGol is distributed through the Apple App Store:

1. These Terms are between you and Beijing Lingxi DeepMind Technology Co., Ltd., not with Apple. Apple is not responsible for OléGol or its content. 2. Your license to use OléGol is limited to a non-transferable license to use it on any Apple-branded product that you own or control as permitted by the Apple Media Services Terms. 3. Apple has no obligation to provide maintenance and support for OléGol. 4. If OléGol fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for OléGol. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to OléGol. 5. Beijing Lingxi DeepMind Technology Co., Ltd. is solely responsible for addressing any claims related to OléGol or your possession or use of it, including product liability claims, claims that OléGol fails to conform to legal or regulatory requirements, and consumer protection or similar claims. 6. We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to OléGol. 7. You represent that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties. 8. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Governing Law and Disputes

15.1 Talk to us first

Before filing a formal claim, please email liuchunxu@miaoboai.com with a description of the issue and what you would like us to do. Most issues can be resolved informally. If we cannot resolve the issue within 30 days of your email, either of us may pursue a formal dispute as described below.

15.2 Governing law

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of the protection of the mandatory consumer-protection rules of your country of habitual residence.

15.3 Forum

Subject to Section 15.4, any dispute arising out of or in connection with these Terms shall be submitted to the People's Court of Haidian District, Beijing.

15.4 Consumers

If you are a consumer in the European Economic Area, the United Kingdom, Switzerland, Brazil, Mexico, Australia, or another jurisdiction with mandatory consumer-protection law, you may also bring a claim in the courts of your country of habitual residence under your local mandatory law, and we may bring a claim against you only in those same courts. Nothing in these Terms limits any non-waivable statutory right you have as a consumer.

15.5 Class actions

To the extent permitted by law, you and we each agree to resolve disputes on an individual basis. Class, collective, and representative actions are not permitted, except where prohibited by applicable mandatory law.

15.6 Time limit

Any claim under these Terms must be brought within one (1) year after the cause of action arises, except where a longer period is required by your local mandatory law.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app or via email before they take effect, and the "Effective date" at the top will be updated. Continued use of OléGol after the effective date means you accept the updated Terms.
